This is an updates to the case management, Admiralty in Personam No. : WA-27NCC-42-07/2016 initiated by Macon Charter B.V. (“Macon”) as the Plaintiff against Samalaju Industrial Port Sdn. Bhd. (“SIPSB”) as the 3rd Defendant which was duly announced to the Bursa Malaysia on 23.08.2016, SIPSB has filed in the following Notice of Application:-
(i) Security for Costs
On the hearing date of 01.12.2016, the Court allows the application of SIPSB with costs of RM2,000.00 to be paid by the Plaintiff to SIPSB and the Plaintiff was ordered to pay security of RM50,000.00 to be placed with Messrs. Shearn Delamore within fourteen (14) days from the date of hearing (ie. 01.12.2016).
(ii) Striking Out
The Court has dismissed the 3rd Defendant’s application for striking out with costs of RM5,000.00 to be paid to the Plaintiff on the grounds that the case is not as almost unsustainable case which deserved to be struck out without going for trial. The Court has on 01.12.2016 fixed the trial date to be on 05.06.2017 and gave the pre-trial direction that Common Bundle of Documents, Summary of Case, Agreed Issued to be tried and agreed facts to be filed on or before the next case management which is fixed on 06.03.2017 before the Judge.
