Personal Data Protection Policy

Introduction

This Personal Data Protection Policy (hereinafter referred to as "the Privacy Policy") applies to Bintulu Port Holdings Berhad, (hereinafter collectively referred to as "BPHB", "our", "us" or "we") and its Group of companies ("the Group") owned or controlled by BPHB. This Privacy Policy outlines how we process personal data and comply with the requirements of the Personal Data Protection Act 2010 ("PDPA").

This Privacy Policy covers BPHB's collection and handling of personal data that is covered by PDPA. It is not intended to cover categories of personal data that are not covered by PDPA. The terms "personal data" and "processing" shall have the meaning prescribed in the PDPA.

1. Collection of Personal Data

BPHB collects personal data from its employees, clients, customers, contractors and other individuals. The main types of personal data BPHB collects relate to the personal and contact details and organisational roles of our clients, suppliers and other business contacts. Personal details would include name, identity card or passport number, gender, race, nationality, date of birth or age, marital status, occupation, job titles, photo, assets, income tax reference number, employees provident fund reference number, social security reference number, financial and banking account details. Contact details would include address, telephone number, fax number, mobile number and email address. During the course of providing professional services to our clients, we may collect more detailed personal data.

We collect most information directly from individuals when we deal with them. The personal data we collect may be provided in forms filled out by individuals, face to face meetings, email messages, telephone conversations or by third parties. If you contact us, we may keep a record of that contact.

The above description of personal data is merely a general description of the various types of personal data that we collect from various individuals. The nature of personal data differs from individual to individual. Depending on the nature of business and circumstances, we may only need to collect and process a more limited form of personal data from certain individuals. In other situations, there may be a need to collect more personal data depending upon the nature of transaction, business and so forth. We do not believe in collecting excessive personal data and what we collect are the essentials that are required to ensure the efficacy of business and transactions.

You may choose whether or not to provide your personal data to us, including sensitive personal data. Sensitive personal data may include such things as information on physical or mental health or medical condition, political opinions, religious or other similar beliefs, commission or alleged commission of any offence.

The personal data you provide will be collected, held on computer and/or in manual files, used, disclosed and otherwise processed by BPHB and/or the Group for the following purposes:

  1. tender evaluation purposes and all other purposes related specifically for tender and contract of BPHB and the Group;
  2. our internal record keeping, maintenance and updating of any information database(s), customer service related matters and other administrative purposes, including audits, fraud monitoring and prevention;
  3. to communicate with you, including responding to your enquiries;
  4. meeting or complying with any legal, regulatory or statutory requirements relating to our provision of services and to make disclosure under the requirements of any applicable laws, legislation, rules, rulings, regulations, directions, court order, by-laws, guidelines, circulars, code (collectively "laws") applicable to us or any member companies of the Group;
  5. research, benchmarking and statistical analysis; and/or
  6. other reasons that are required or permitted under the Personal Data Protection Act 2010 or other applicable laws.

Other than the above, we do not collect personal data for any other reasons. Should there be a new purpose for the collection of data, we shall inform you accordingly and obtain your concurrence to the same, where necessary.

We treat the confidentiality of your personal data very seriously, which is of utmost importance to us. Personal Data provided to BPHB by you will be kept confidential. However, in certain circumstances, it would be necessary for us to provide or disclose your personal data for the purposes stated above to the following categories of persons (whether within or outside Malaysia) and where we do so, we would merely disclose data that is necessary for the purpose of such disclosure:

  1. entities within the BPHB Group of Companies including all related companies, subsidiaries, holding companies and associated companies;
  2. anybody or person to whom the Company is compelled or required to do so under any laws or in response to any competent or government, state, provincial, local government, statutory or municipal authority, industry regulators, agency or body;
  3. law enforcement authorities;
  4. such sub-contractors or third party service (an example would be auditors, lawyers, service providers, events and training organisers, telecommunications companies, data back-up service providers and other advisers).

In addition, where we consider it necessary or appropriate for the purposes of the conduct of business, data storage or processing or customer management, we may transfer your personal data to another member of the Group or third party service within or outside the country in which BPHB is established, under strict conditions of confidentiality and similar levels of security safeguards.

We shall endeavour to implement the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to prevent the unauthorized or unlawful processing of your personal data and the accidental loss or destruction of, or damage to, your personal data.

We will provide access to personal data upon request by an individual, except in the limited circumstances pursuant to PDPA, in which it is permitted for us to withhold this information.

When you make a request to access personal data, we will require you to provide some form of identification so we can verify that you are the person to whom the data relates.

In the event of any inconsistency or conflict between the English language version and the Bahasa Malaysia version of this Personal Data Protection Policy or Notice, the English language version shall prevail.

If you believe that data we hold about you is incorrect or out of date, or if you have concerns about how we are handling your personal information, please contact us and we will try to resolve those concerns.

If you wish to have your personal data deleted, please let us know and we will take reasonable steps to delete it (unless we need to keep it for legal, auditing or internal risk management reasons).

If BPHB becomes aware of any on-going concerns or problems concerning our privacy practices, we will take these issues seriously and work to address these concerns.

BBPHB operates in a dynamic and ever-changing business environment. Over time, aspects of our business may change as we respond to changing market conditions. This may require our policies to be reviewed and revised. BPHB reserves the right to change its policy at any time and notify you by posting an updated version of the policy on this website.

The amended policy will apply between us whether or not we have given you specific notice of any change.
