REPORT MISCONDUCT SAFELY AND CONFIDENTIALLY

BPHB Group is committed to maintaining the highest standards of integrity, transparency, accountability, and ethical conduct. Any form of improper conduct or misconduct may be reported through the established whistleblowing channels provided by the Company.

WHAT IS WHISTLEBLOWING?

Whistleblowing is the act of reporting or disclosing information about suspected wrongdoing or misconduct within the Company through established reporting channels.

OBJECTIVE OF THE WHISTLEBLOWING

  • To provide a safe, confidential and structured channel for reporting suspected improper conduct.
  • To promote a culture of integrity, transparency, and accountability within the Company.
  • To enable early detection and prevention of fraud, corruption, misconduct, and unethical behaviour.
  • To ensure all whistleblowing reports are handled fairly, independently, and in accordance with due process.
  • To protect whistleblowers from retaliation or detrimental action when reports are made in good faith.
  • To support compliance with relevant laws and standards, including the Whistleblower Protection Act 2010, MACC Act 2009, and ISO 37001 Anti-Bribery Management System (ABMS).

WHO CAN BE A WHISTLEBLOWER?

A whistleblower can be any person who reports suspected wrongdoing related to the Company through proper channels.

 

Internal parties (inside the organisation)

  • Employees (permanent, contract, temporary)
  • Interns / trainees

External parties (outside the organisation)

  • Suppliers and vendors
  • Contractors and subcontractors
  • Consultants
  • Service providers
  • Customers
  • Clients

WHAT TO DISCLOSE

  • Corruption, bribery, or kickbacks
  • Fraud, theft, or financial misconduct
  • Abuse of power or authority
  • Conflict of interest
  • Breach of laws or regulations
  • Breach of company policies or Code of Conduct (i-CoBE)
  • Misuse of company resources or information
  • Safety, security, or environmental violations
  • Any act that may harm the reputation or interest of the Company

INFORMATION REQUIRED FOR WHISTLEBLOWING REPORT

To facilitate assessment and investigation, whistleblowers are encouraged to provide the following information where available:

  • Details of person(s) involved (name, department, role if known)
  • Nature of allegation (what happened)
  • Date, time, and location of incident
  • Description of how the incident occurred
  • Supporting evidence (documents, emails, photos, records)
  • Names of witnesses (if any)
  • Previous related incidents (if applicable)
  • Contact details of whistleblower (optional but encouraged for follow-up purposes)

HOW TO DISCLOSE (REPORTING CHANNELS)

Reports may be submitted through any of the following official whistleblowing channels:

  • Whistleblowing Form via BPHB Official Website
  • Email to whistle@bintuluport.com.my
  • Written submission to :
    • Head of Governance, Integrity & Compliance Department
  • Hotline : 086 - 291362
  • In-person meeting (by appointment with GICD)

All reports received shall be reviewed by the Governance, Integrity & Compliance Department and managed in accordance with the Company’s internal procedures.

ANONYMOUS REPORTING

Whistleblowers are encouraged to provide their identity and contact details to facilitate communication and follow-up. However, anonymous reporting is also permitted as part of the Company’s commitment to provide a safe and accessible reporting environment.

 

Anonymous reports will be accepted and assessed based on:

  • Seriousness of the allegation
  • Credibility and clarity of information provided
  • Availability of supporting evidence
  • Ability to verify the information through independent sources

 

CONFIDENTIALITY & PROTECTION

All whistleblowing reports and personal information will be treated with strict confidentiality and will only be disclosed on a need-to-know basis for investigation purposes, in accordance with applicable laws and internal policies.

 

The Company strictly prohibits any form of retaliation against whistleblowers who report in good faith. Any act of retaliation or detrimental action may result in disciplinary action.

 

All reports will be acknowledged within a reasonable timeframe and assessed promptly in accordance with internal procedures. Where contact details are provided, updates on the status of the report may be communicated to the whistleblower where appropriate.

THE DO’s

  • Report in good faith with an honest belief that the information is true.
  • Provide clear, accurate, and complete information.
  • Use official reporting channels only.
  • Maintain confidentiality of the report.
  • Provide supporting evidence where available.
  • Cooperate with the investigation process is contacted.

THE DON’T’s

  • Do not make false, malicious, or fabricated allegations,
  • Do not misuse the whistleblowing channel for personal disputes or grievances.
  • Do not spread rumours or disclose the case to unrelated parties.
  • Do not interfere with or obstruct investigations.
  • Do not retaliate against any person involved in the process.
  • Do not disclose confidential investigation details publicly.

IMPORTANT NOTICE

Misuse of the whistleblowing channel, including false, malicious, or bad faith reporting, may result in appropriate disciplinary or legal action in accordance with the Company’s policies and applicable laws.
